Certainly. In one instance, a major film production faced a trademark infringement suit just weeks before its scheduled release, where the opposing party sought a stay on the movie’s title. We promptly defended our client before the Hon’ble District Judge(Commercial Court), Patiala House Court, New Delhi which, after hearing our arguments, declined to grant the injunction and allowed our client to release the movie without a title change. In another matter, our client’s well-known brand was subjected to disparagement through a derogatory remark in a comparative advertisement. Recognizing the unfair trade practice and the potential harm to reputation, we immediately approached the Hon’ble Court and secured an interim injunction along with an order for the takedown of the defamatory advertisement. This resulted in favorable relief in a trademark disparagement suit, effectively safeguarding our client’s goodwill and market standing.

I coordinate with trusted associates in foreign jurisdictions to make sure that filings meet local formalities and deadlines. I also address cultural, linguistic, and procedural differences to avoid delays or refusals. My focus is to give clients a seamless experience where their IP is protected consistently across borders, without unnecessary duplication of effort or cost.

A widespread misconception among businesses is that simply registering intellectual property equates to full protection. Many believe that once an IP is registered, their rights are automatically safeguarded everywhere. In reality, registration is just the first step—it does not guarantee absolute protection unless enforced and maintained. Additionally, IP rights are territorial, meaning protection applies only in jurisdictions where registration is secured. We address this concern by educating clients on the importance of ongoing monitoring, enforcement, and strategic filings across relevant markets to ensure their IP is truly protected and effective in supporting their business objectives.

In one recent trademark infringement matter, an interim injunction obtained in favor of our client was challenged before the Hon’ble High Court, and we successfully defended it, thereby safeguarding the client’s rights. In another matter, where an injunction had initially been granted against our client at the trial stage, we approached the Hon’ble High Court and, after presenting the complete facts, succeeded in having the injunction vacated, obtaining relief for our client. Additionally, in one city, we represent three different clients in the same industry and have taken legal action against multiple infringers. Interestingly, several infringers banded together to collectively fight back, resulting in multi-state litigation—truly a case of ‘birds of a feather flock together’—yet we continue to defend our clients effectively and uphold their rights.
Prime Insights: What are your goals as an IPR consultant or firm in 2025 and beyond?
Looking ahead to 2025 and beyond, our goals include expanding our presence across more Indian cities to better serve regional clients. We have already expanded to Ranchi, Kanpur, and Ahmedabad and plan to continue this growth to further strengthen our regional outreach. We aim to develop specialized teams concentrate on new technologies such as artificial intelligence and blockchain, which are transforming the IP landscape. Moreover, we seek to enhance our international enforcement and prosecution capabilities to provide seamless global protection for our clients’ intellectual property assets.

My advice is to protect your intellectual property as early as possible, ideally before launching products or services. Many successful startups fail to protect their IP adequately and subsequently face copycats, resulting in significant revenue loss and damage to their brand reputation. Therefore, it is crucial to continuously monitor your IP assets and the marketplace for potential infringements and act decisively when violations occur. Treat intellectual property as a core business asset—register it in all relevant jurisdictions, maintain vigilant enforcement, and leverage it strategically to enhance your competitive advantage and revenue streams.
